Martha Lewis joined Invictus Chambers in October 2017 after the successful completion of her pupillage.

At a time where alternative dispute resolution is becoming an ever-more important method for resolving disputes, Martha is looking to develop her skills as a civil and commercial mediator.

BACKGROUND

Property and landlord and tenant

Martha has extensive experience in property law, having worked as a fee earner in the property litigation team at a large firm of Solicitors before commencing pupillage. As a fee earner, Martha dealt with matters including adverse possession, easements, covenants, trespass, nuisance, harassment and committal proceedings.

Martha has a keen interest in landlord and tenant law. She has dealt with matters such as disrepair, breach of covenants in leases and leasehold enfranchisement.

Within the areas of property and landlord and tenant law, Martha has drafted a variety of documents to include pleadings, advices, applications, court orders and Part 36 offers.

Martha has attended numerous court hearings in these areas and conducted several directions hearings in the County Court. She has conducted conferences with clients, negotiations and without prejudice meetings with opposing counsel.

Probate

During pupillage, Martha has attended conferences, conducted research and drafted advices in relation to various contentious probate matters to include –

  • 1975 Act claims;
  • Undue influence;
  • Proprietary estoppel;
  • Probate for foreign domiciles;
  • Inheritance tax and sovereign immunity;
  • Determining whether money given to an adult child prior to their parent’s death was a gift or a loan, now owed to the estate.

Previously Martha has worked in the wills and probate department of a high-street Solicitors firm, assisting in the administration of estates and the drafting of wills and powers of attorney. This experience has greatly assisted her ability to assess contentious probate matters.

Commercial

Martha has worked on numerous commercial and company law cases since joining Invictus Chambers. She has dealt with matters including enforceability of mortgage deeds; enforceability of guarantees; undue influence; creation of contracts; director’s duties under the Companies Act 2006, transmission of shares and the requirements for a valid CFA.

Within this area, Martha has drafted pleadings, skeleton arguments, application notices, court orders and Part 18 requests for further information 

Professional negligence

Martha has assisted in a number of professional negligence matters against Solicitors and conveyancers, to include drafting Particulars of Claim and a claimant’s Part 36 offer.

Housing

In the area of housing law, Martha has dealt with matters to include anti-social behaviour injunctions and committal for breach of the same, exclusion orders, possession proceedings and succession.

Martha has defenced possession proceedings in the county court and drafted a skeleton argument in anti-social behaviour proceedings.

ABOUT MARTHA

Outside of the law, Martha’s interests include reading, martial arts and climbing. Her undergraduate degree was in modern languages, for which she studied German, Spanish and Portuguese. Since completing her degree she has been learning Japanese.
